Who these terms are between

They are between you and xAverage Technologies Pvt. Ltd., a company incorporated in India and operating from Bengaluru, Karnataka, India. In this page, we and us mean the company, and you means the person reading the site. We have kept them short and in plain language on purpose.

Accepting these terms

By browsing this site you agree to these terms — that is the whole ceremony. There is no account to create and nothing to sign, and we have tried to make the terms easy enough that agreeing to them costs you nothing.

What this site is

This is our company website. It describes who we are, what we build, and where to find our products. It is information, offered in good faith — not an offer, a quotation, or a contract to supply anything.

Using this website

You are welcome to read it, link to it, and quote it with attribution. We only ask that you use it lawfully and considerately — in particular, please do not:

• use it in a way that breaks a law or infringes someone else’s rights;
• try to reach any part of it, or any system behind it, that is not meant to be public;
• interfere with how it runs, including with automated traffic that degrades it for others;
• submit anything unlawful, abusive, misleading or deliberately automated to our forms; or
• copy the site wholesale, or scrape it at a rate no person could, to reproduce it elsewhere.

When you send us a message or an e-mail address, please make sure it is yours to send and accurate. Our forms reach an ordinary enquiry inbox, so kindly keep confidential material and other people’s personal data out of them. How we look after what you send is set out in our privacy policy.

Writing to us does not, by itself, create a confidentiality obligation, a partnership, or a duty on us to reply — though we do try to reply to everything genuine. If you send us an idea or a suggestion unasked, you are giving us the freedom to use it without owing you anything for it.

Our products

Our products live on their own domains, each with its own terms and its own privacy policy — wtn.live is one example. Those terms govern your use of that product; these govern only this site. Anything this site says about what we are building describes our intent at the time of writing — plans evolve, and a description here is not a promise that a particular thing will ship, or ship in a particular form or by a particular time.

Intellectual property

The name xAverage, our logo, our product names, and the design and words of this site belong to us or to the people we license them from. Quote a reasonable extract with attribution and a link, and we are happy. Please do not use our name or logo in a way that suggests we endorse you, or present our work as your own.

Links to other sites

Where we link out, the site at the other end is not ours and we are not responsible for it. A link is a pointer, not an endorsement — the terms and privacy policy of the site you arrive at are the ones that apply there.

Availability

We work to keep the site fast and available, and we also reserve the ordinary freedoms of running one: we may change, move, or take down any part of it, including for maintenance, without notice.

Disclaimers

The site is provided as it stands. We take real care to keep it accurate, and still we cannot warrant that everything on it is complete, current, or fit for a particular purpose. It is general information about a company and its products — not professional, legal, financial or technical advice. For a decision that matters, please write to us and ask; we would rather answer a question than have you guess.

Limitation of liability

To the extent the law allows, we are not liable for loss of profit, loss of business, loss of data, or any indirect or consequential loss arising from your use of this site or your inability to use it. Nothing here limits liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence.

Governing law and jurisdiction

These terms are governed by the laws of India, and the courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising from them or from your use of this site.

If part of these terms cannot be enforced

If a court finds any part of these terms invalid or unenforceable, that part falls away and the rest continues to apply.

Changes to these terms

We may update these terms as the site and the company grow. The current version is always the one on this page, with its version and date at the top. Using the site after a change means the updated terms apply.
